Fixed tanks (tank-vehicles) and demountable tanks constructed before 1 January 2003 in accordance with the requirements of 6.8.2.1.21 in force up to 31 December 2002 but which do not, however, conform to the requirements applicable as from 1 January 2003 may still be used.

Fixed tanks (tank-vehicles) and demountable tanks constructed before 1 July 2003 in accordance with the requirements in force up to 31 December 2002 but which do not, however, conform to the requirements of 6.8.2.1.7 applicable as from 1 January 2003 and special provision TE15 of 6.8.4 (b) applicable from 1 January 2003 to 31 December 2006 may still be used.

Vacuum-operated waste fixed tanks (tank-vehicles) and demountable tanks constructed before 1 July 2005 in accordance with the requirements applicable up to 31 December 2004 but which do not conform to the requirements of 6.10.3.9 applicable as from 1 January 2005, may still be used.

Fixed tanks (tank-vehicles), demountable tanks and tanks forming elements of battery-vehicles designed and constructed in accordance with a technical code which was recognized at the time of their construction according to the provisions of 6.8.2.7 which were applicable at that time may still  be used.

Fixed tanks (tank vehicles) and demountable tanks constructed before 1 July 2007 in accordance with the requirements in force up to 31 December 2006, equipped with manhole cover assemblies in accordance with the provisions of standard EN 13317:2002 referred to in the table of paragraph 6.8.2.6, applicable until 31 December 2006, including those of the figure and table B.2 of annex B of the said standard which are no longer accepted as from 1 January 2007, or the material of which does not meet the requirements of EN 13094:2004, paragraph 5.2, may still be used.

When the shell of a fixed tank (tank-vehicle) or demountable tank was already divided by partitions or surge plates into sections of not more than 7 500 litres capacity before 1 January 2009, the capacity of the shell need not be supplemented with the symbol "S" in the particulars required by 6.8.2.5.1 until the next periodic inspection according to 6.8.2.4.2 is performed.
